Trademark FAQs - related questions & answers
Question: How different does one trademark have to be from another?
Answer: After an application is filed, the assigned examining attorney will search the USPTO records to determine if a conflict exists between the mark in the application and another mark that is registered or pending in the USPTO.
Question: Should local businesses care what trademark someone else in another part of the country is using?
Answer:
Yes. Vast numbers of businesses, even local, have put up their own websites, creating the potential for confusion in the marketplace.
Question: Are there any restrictions from trademarking a product name that contains Spanish words?
Answer:
The same laws and rules apply to marks in languages other than English. Other than those requirements, a non-English mark would have to be translated for the record.
